1. Introduction

These Terms and Conditions ("Terms") govern your use of Dazno.de ("Service"), a Lightning Network node analysis platform operated by Inoval ("Company", "we", "us", or "our"), a company registered in France under RCS NANTES.

By accessing or using our Service, you agree to be bound by these Terms.

2. Geographic Restrictions

Our Service is only available to users located within the European Economic Area (EEA), Switzerland, and the United Kingdom. Access from other jurisdictions is prohibited.

We reserve the right to restrict access based on IP geolocation and may require additional verification of your location.

3. Service Description

Dazno.de provides Lightning Network node analysis tools and services designed to help users:

• Analyze Lightning Network node performance
• Optimize Return on Investment (ROI) for Lightning nodes
• Access market data and analytics via api.dazno.de
• Receive recommendations for node optimization

4. User Accounts and Registration

4.1 You must provide accurate, current, and complete information during registration.
4.2 You are responsible for maintaining the confidentiality of your account credentials.
4.3 You must be at least 18 years old to use our Service.
4.4 We reserve the right to suspend or terminate accounts that violate these Terms.

5. Lightning Network Integration

5.1 Our Service may require connection to Lightning Network nodes via API.
5.2 You acknowledge that Lightning Network operations involve inherent risks.
5.3 We are not responsible for losses incurred through Lightning Network activities.
5.4 You must ensure compliance with local regulations regarding cryptocurrency activities.

6. Payment Terms

6.1 All prices are displayed in Euros (EUR) and include applicable French VAT (TVA).
6.2 Payment is due immediately upon order confirmation.
6.3 We accept major credit cards and SEPA bank transfers.
6.4 Subscriptions automatically renew unless cancelled before the renewal date.
6.5 Invoices are issued in accordance with French tax regulations.

7. Refund Policy

7.1 Digital services are generally non-refundable once delivered.
7.2 In accordance with French consumer law, you have a 14-day withdrawal right for distance sales.
7.3 Refunds may be provided at our sole discretion for technical issues preventing service usage.
7.4 Subscription cancellations take effect at the end of the current billing period.

8. Data Protection and Privacy

8.1 We process personal data in accordance with our Privacy Policy, GDPR, and French Data Protection Act.
8.2 Lightning node data is encrypted and stored securely.
8.3 We do not share user data with third parties except as required by law.
8.4 Users have the right to access, rectify, and delete their personal data.

9. Intellectual Property

9.1 All content, algorithms, and analysis tools are proprietary to Inoval/Dazno.de.
9.2 Users receive a limited, non-exclusive license to use the Service.
9.3 Reverse engineering or copying our algorithms is strictly prohibited.
9.4 All intellectual property rights are protected under French and European law.

10. Disclaimers and Limitations

10.1 The Service is provided "as is" without warranties of any kind.
10.2 We disclaim all warranties, express or implied, including merchantability and fitness for purpose.
10.3 Lightning Network analysis involves inherent uncertainties and risks.
10.4 Past performance does not guarantee future results.
10.5 Cryptocurrency investments carry significant financial risks.

11. Limitation of Liability

11.1 In accordance with French law, our liability is limited except for gross negligence or willful misconduct.
11.2 Our liability for direct damages is limited to the amount paid for the Service in the 12 months preceding the claim.
11.3 We are not liable for indirect, incidental, or consequential damages.
11.4 We are not responsible for losses due to Lightning Network volatility or technical issues.

12. Prohibited Uses

You may not:

• Use the Service for illegal activities under French or European law
• Attempt to reverse engineer our algorithms
• Share account credentials with third parties
• Use automated tools to access the Service without permission
• Violate any applicable cryptocurrency regulations
• Use the Service for money laundering or terrorist financing

13. Termination

13.1 Either party may terminate the agreement with 30 days' notice.
13.2 We may immediately terminate for violation of these Terms.
13.3 Upon termination, access to the Service will be revoked.
13.4 Data export options are available for 90 days post-termination.

14. Governing Law and Jurisdiction

14.1 These Terms are governed by French law.
14.2 Any disputes shall be resolved in the competent courts of Nantes, France.
14.3 For consumer disputes within the EU, the European Online Dispute Resolution platform may be used: https://ec.europa.eu/consumers/odr/
14.4 French consumers may also contact the CNIL for data protection matters.

15. Changes to Terms

15.1 We may update these Terms with 30 days' notice via email and website notification.
15.2 Continued use constitutes acceptance of revised Terms.
15.3 Material changes will require explicit user consent.

18. Severability
